Welcome to Stayhighislandcampingco.co.nz - we're stoked you've chosen to go on an adventure with us and look at booking one of our rentals. These Terms and Conditions govern the rental &/or purchase of any product via Stayhighislandcampingco.co.nz 
By looking to book or purchase product from our Website, you agree to be bound by these terms and conditions, our Terms of Service Agreement, & our Privacy Policy. This Website is owned and operated by Stay High Island Camping Co. Should you have any questions, please contact us: info@stayhighislandcampingco.co.nz

GENERAL

We will always attempt to be as accurate as possible, however we are unable to warrant that rental prices, descriptions or other content on the Website is 100% accurate, complete, reliable, current or error free.

Colours may vary slightly from those displayed by your monitor.

PRODUCT AVAILABILITY

The Website offers equipment for rental that we expect to be in excellent working or and quality. All rental equipment (and products, such as veggie boxes) are to be picked up from our depot in Claris. 

In the event that specific date ranges are unavailable for certain equipment / products are sold out, SOLD OUT will be displayed instead of the ADD TO CART feature and calendar dates will show as unavailable.  

Although the Website contains a feature that removes unavailable equipment /product from the online store, occasionally there maybe a chance equipment / a product becomes unavailable before the Website is updated. In the unfortunate circumstance where we are unable to fulfil your order (In part, or in full) we will advise you as soon as possible so you can consider alternative dates or receive a refund.

We reserve the right to cancel certain parts, or all of your booking (& issue you a refund in accordance). This will most likely be due to (but not limited to) unavailable items in the case of double booking / broken equipment.  

Please note that bookings in your shopping basket are reserved for 15mins only to prevent other customers over - booking you. You will be notified of your time at the top of your screen. Once 15mins is over, you calendar items will be removed from your cart and free again for others to book. 

PAYMENTS

Prices of product, services and other charges displayed on Website are current at the time of display. These prices are subject to variation.

We accept payment from Visa, MasterCard, Paypal, Bank Deposit or such other methods we may accept in the future. Payment is debited from your card at the time of your order unless Bank deposit is selected in which case, you will be given our bank details upon checkout and expected to transfer within 24hrs of time of booking (or we reserve the right to cancel your booking).

All card transactions on this Website are processed using Shopify payments which is a secure online payment gateway that encrypts your card details in a secure host environment.

Payment must be made in full at the time of your online booking.


All payments shall be through the website unless otherwise agreed upon.

 CURRENCY

All prices are shown in New Zealand Dollars (NZD). All transactions will occur in New Zealand dollars. Non-New Zealand currency figures are all approximations based on an exchange rate

Prices are subject to change without notice. 

YOUR ORDER

All bookings are subject to acceptance by us and availability.

After you create a booking, you will receive either an order confirmation or an order cancellation email:

  • Order Confirmation: This email confirms that we have received your booking and that your payment has been received. This email will include an individual order/booking number.
  • Order Terms & Process: By creating a booking, you are offering to rent (& in some cases purchase) the Equipment/products for the price indicated. After a booking has been placed, we will send you an email confirming the placement of your booking. Stay High Island Camping Co reserves the right to take reasonable steps to verify that a booking and/or credit card details we receive from you are genuine before we accept the order. We are only bound to provide you with the rental if we have accepted your booking and received cleared funds as payment. Once your offer has been accepted, we will send you an email with your Order/Booking Number. In the event that Equipment/a product you have booked is unavailable, we will notify you via email or phone regarding this.
  • Order Cancellation: This email will notify you that the product/equipment you have sought, or the dates you have chosen to purchase/book are unavailable. We expect this to only occur rarely as we update our calendars and stock levels on the Website regularly. In the event that this does occur, we will give you the option of a refund (for the unavailable product/service) or re-selecting available dates / another product from the Website. An order confirmation is NOT an acceptance of your order, just a confirmation that we have received it and that payment has been approved. We will send you a further email confirming your booking acceptance with information regarding the commencement of your rental. 

We reserve the right not to accept your booking in the event, for example, that we are unable to obtain authorisation for payment, that the equipment booked is out of stock or does not satisfy our quality control standards and is withdrawn. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product/service from the Website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

CANCELLATIONS

By Us:

We reserve the right not to provide product or services, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.

If your order is cancelled, you will receive an email from us. It will explain the reasons for the cancellation. You will not be billed for any order we cancel. Once an order is cancelled, it cannot be reprocessed and must be submitted again via the Website. Where you have provided a contact phone number with your order, we may try to contact you by phone to discuss your options.

By You:

Once an order has been submitted by you it maybe cancelled however, penalties may occur. If you need to cancel or change a booking, please contact us immediately with your order number and the details of your requested instructions. We will use reasonable endeavours to accommodate your request however cancellation of the order is within our sole discretion. You can read our cancellations policy below.

CANCELLATIONS / RE-SCHEDULING

  • For all cancellations and refunds, an administration/cancellation fee of $40 will apply.  I am also responsible for paying Shopify's booking fee attached to my order (3.6% of order total).
  • I will receive a full refund of my booking amount if I cancel at least 30 days prior to the Pickup Date.  If I cancel between 14-30 days before my Pickup Date, then I will receive a 50% refund.  If I cancel within 14 days of the Pickup Date, I will not receive a refund of my booking or any other amounts paid to the Company and I will be responsible for 100% of the full reservation total.
  • I can reschedule my booking so long as I am not within 30 days of my booking, unless the change is due to impending weather. If the weather forecast for your trip is looking terrible in the days leading up to the booking, you may reschedule with us. Please give us a call..

  • If my flight or ferry to the island is cancelled due to poor weather conditions, or any reason outside of your control, I will be offered a chance to reschedule my booking or transfer my booking to another Party within the next 12 months. This will not be at any extra cost to me.  If I require a refund, because I am unable to complete a booking in the next 12 months, please contact the Company.  Administration/cancellation fee of $40 will apply. 

  •  Any credit held with the Company may be transferred to another Party as long as the details of the booking remain the same or are in line with cancellation/rescheduling policy.  Administration fee of $10 will apply. 

  • Should the Rented Equipment become damaged or unavailable for any reason prior to the scheduled time of pickup on the Pickup Date, the Company will use reasonable efforts to notify me as soon as possible. If replacement equipment is not available or the Company is unable to arrange a reasonably satisfactory alternative as determined by myself, then the Company will refund 100% of the full reservation total.  The Company also expressly reserves the right to terminate this Agreement and cancel the reservation at any time prior to my taking physical possession of the Rented Equipment, for any or no reason, in which case the Company will refund 100% of the full reservation total. If the Company cannot provide replacement equipment or terminates this Agreement or cancels the reservation, the Company will not be liable for any damages or charges in such event, including without limitation, any costs I may incur for flight changes, itinerary changes or substitute equipment rental.

 GIFT CARDS

  • Gift cards can only be used through our online store stayhighislandcamping.co.nz
  • You cannot purchase an online gift card with another gift card.
  • If the amount of your online gift card(s) does not cover the total order amount, you will need to pay the remainder of the purchase using another payment method. (Credit card, PayPal etc).
  • If the amount of your online gift card is more than the total order amount, the balance will remain on your gift card for your next purchase using the same gift certificate code.
  • Online gift cards are non-refundable and are not redeemable for cash.
  • We cannot replace lost or stolen online gift cards, but we can resend gift cards to the email address used to purchase it. Simply contact us with your inquiry.

  • Should you need to cancel your adventure with us bought with the use of a gift card, we will issue a refund by way of credit back to the gift card up to the value of the amount redeemed, and by regular refund for the value exceeding the value of the gift card.
  • All purchased gift cards are valid for 24 months from date of purchase unless stated otherwise. We can not extend expired gift cards.
  • All Gift cards sold are in New Zealand Dollars (NZD).

 Please note:

  • Upon completion of your purchase of a gift card you will be emailed confirmation the order has been completed.
  • You will then receive an email with the link to view your gift card.  You can print and/or download the gift card to save for yourself or forward to another recipient.

 

RENTAL TERMS & CONDITIONS

The following is a formal rental agreement/release of liability that you will be required to sign upon picking up your booked rental equipment.  Once this document is signed and returned to the Company, & the booking is paid for, the rental agreement begins.

ACCEPTANCE AND RETURN OF RENTED EQUIPMENT (Vehicle, camping gear, etc.)

  • By using the Rented Equipment, I agree that I have inspected the Rented Equipment and that it is in good, clean, working order and I agree to return the Rented Equipment in good, clean, working order on the Return Date.  This includes the interior of the vehicle, tents, and any camping gear provided by the Company. 
  • I agree to schedule a pickup time with the Company for a time on the Pickup Date between the hours of 2pm and 6pm at the depot in Claris or another place that is agreed upon.
  • I will schedule a return time with the Company for a time on the Return Date between 9am and 11am.  If I am more than 30 minutes late, then I will be charged at a rate of $40/hr.  For example if the scheduled drop off time is 2:30 and I return the rented equipment at 4:45, I will be charged $90.  If I return the rented equipment at 3:00, I will be charged $20.  I must do my best to notify the Company if I am running late. 
  • I understand that the price I am paying is per night, and that I must drop off the Rented Equipment at the scheduled Return Date unless otherwise agreed upon. 
  • If I have scheduled the return at the depot in Claris, and I leave the Rented Equipment there for a period of time prior to the schedule time of pickup by the Company, then I will be responsible for any and all damages that may occur to the Rented Equipment prior to the time that the Company was scheduled to pick up the Rented Equipment. 
  • If a Company representative is not present at the time of drop-off on the Return Date, then I will park the car in the same space, lock the doors, and put the keys atop the front driver side door or in the lock box, whichever is requested by the Company.
  • I will not receive any refund if I return the Rented Equipment early.
  • The vehicle will be provided with a full fuel tank. I agree to return the vehicle with a full fuel tank or I will be charged the cost to fill the fuel tank plus a $40 fuel charge.
  • I agree to assume all risk of loss, damage, or excessive dirtiness to the Rented Equipment.  I will notify the company if this occurs. I accept that I will be charged at a rate of $40/hr for cleaning, or charged the cost of replacement. 
  • I may be able to extend my booking during my trip subject to availability.  This must be arranged with the Company during my trip and must be booked through the website.

 

BOOKING FEES AND RESERVATIONS 

  • I agree to allow the Company to take a photograph copy of my driver’s license and credit card information upon my pickup.  Any additional driver’s licenses will also be photographed. If I cannot provide a valid driver’s license at the time of pickup, I will not be able to use the vehicle and I will be responsible for 100% of the full reservation total.  I will not be given a refund.

CANCELLATIONS & RESCHEDULING
  • No cancellation fee will be charged and I will receive a full refund of my booking amount if I cancel at least 30 days prior to the Pickup Date.  If I cancel between 14-30 days before my Pickup Date, then I will receive a 50% refund.  If I cancel within 14 days of the Pickup Date, I will not receive a refund of my booking or any other amounts paid to the Company and I will be responsible for 100% of the full reservation total.

If replacement equipment is not available or the Company is unable to arrange a reasonably satisfactory alternative as determined by myself, then the Company will refund 100% of the full reservation total.  The Company also expressly reserves the right to terminate this Agreement and cancel the reservation at any time prior to my taking physical possession of the Rented Equipment, for any or no reason, in which case the Company will refund 100% of the full reservation total. If the Company cannot provide replacement equipment or terminates this Agreement or cancels the reservation, the Company will not be liable for any damages or charges in such event, including without limitation, any costs I may incur for flight changes, itinerary changes or substitute equipment rental. 

 

CREDIT/DEBIT CARD INFORMATION HOLDING AND CHARGES

 

  • I will supply credit or debit card information to the Company upon booking and again on my Pickup Date in the form of photographs to be kept on the Company phone.  If these details cannot be supplied at both the time of booking and on the Pickup Date, my reservation may be cancelled without refund.  The Company will not be liable for any damages or charges in such event, including without limitation, any costs I may incur for flight changes, itinerary changes, or substitute equipment rental.  
  • My credit or debit card information will be deleted from the Company phone within seven (7) days of the date that I return the Rented Equipment assuming the Rented Equipment is returned in the condition required under this Agreement. If the Rented Equipment is not returned in the condition required under this Agreement, the Company is authorized hold onto the card information and deduct any costs to clean and repair the Rented Equipment.  
  • The Company will promptly inform me of any damages and charges that may be due, provided that the Company reserves the right to assess additional damages and charges if any further causes are later identified and were not declared at the time of return. The Company agrees to provide me with a detailed receipt and cost of cleaning and replacement items that may be charged to my supplied credit or debit card under this Agreement. 
  • I agree that any and all additional charges that I may be responsible for under this Agreement may be charged to my credit or debit card. For any charges, I will promptly pay the Company any balance within thirty (30) days of receipt of written notice from the Company.  
  • I am responsible for the cost of any repairs incurred by the Company resulting from the reckless, negligent or imprudent use of the Rented Equipment or any breach of this Agreement.  

 

TERMS GOVERNING THE USE OF THE RENTED EQUIPMENT

  

  • For drivers 25 and over, the standard excess is $2,000.  For drivers aged, 21, 22, 23, and 24, the standard excess applied is $3,000.   For the purposes of this section of the Agreement, the stated excess charges are assuming the driver is 25 or over.  If under 25, an additional $1,000 excess will be added to all excesses listed below.
  • I agree to allow copies of both my Driver’s License and Credit/Debit Card to be taken by the Company on the Pickup Date.
  • I may only use the vehicle on public roads on Great Barrier Island. The vehicle may not be used on any closed roads or off-road areas. If this happens, I am immediately in violation of the rental agreement and will be charged the $2,000 excess.  I am allowed to use the Rented Equipment on private land if being used for camping purposes or accessing secondary accommodation, and this must be confirmed with the Company on the Pickup Date.   
  • The vehicle may not be driven on the beach, or to cross streams or rivers.  If this happens, I am immediately in violation of the rental agreement and will be charged the $2,000 excess.  
  • The vehicle may not be driven through any flooded roads.  If this happens, I am immediately in violation of the rental agreement and will be charged the $2,000 excess.
  • The rented equipment may not be used on the beach. 
  • The vehicle may not be used to tow any equipment unless agreed upon with the Company.  If this happens, I am immediately in violation of the rental agreement and will be charged the $2,000 excess.
  • If the vehicle is stolen or vandalised to the point of repair, I will be charged the $2,000 excess.
  • If I damage the windscreen or damage or puncture a tyre, I will be charged the $250 excess.
  • I must use the tent and/or awning set up video downloaded to the supplied iPad when setting up this equipment, and the Company will confirm this on my Pickup Date.  I accept that these are the only instructions that will be provided to me regarding setting up the roof top tent and awning.  
  • I am solely responsible for where I use the Rented Equipment and I will verify road conditions/terrain in advance of my travel.  
  • I accept that in order to rent the Suzuki Samurai Stay Grounded package, that I must be a proficient driver of manual transmission.  If any damage is done to the clutch, engine, or any other part of the vehicle due to misuse of the manual transmission, I will be liable for any repair.
  • I accept that I will only engage 4WD if the car is stuck, or it is needed to be used on a reasonable private road for the purposes of accessing accommodation.  Otherwise, there is no need to use 4WD.  
  • I will follow all traffic laws and obey all traffic signs and speed limits, and accept that generally speaking, there is no need to go over 60km/hr on any part of the road.  
  • I will pay any and all penalties incurred during my rental period, including parking and traffic law fines.
  • I am responsible for paying any overnight fees as charged by the Department of Conservation for camping.  
  • I am responsible for disposing of my rubbish at the local tip, otherwise I am liable for a $40 tip fee plus the cost to dispose of the rubbish.
  • The consumption of alcohol or other intoxicants is not allowed while operating the vehicle. I warrant that I have no physical disabilities that would impair my driving, and I am not under any instruction not to drive by a doctor. This applies to all other authorized drivers and I will be responsible for ensuring that the same is true and complied with. 
  • I understand that extracting a vehicle that is stuck because of road conditions/terrain may be unavailable. I will be solely responsible for all expenses related to a stuck vehicle because of road conditions/terrain. 
  • I will immediately contact the Company upon the occurrence of any breakdown, accident or vehicle break-in. I will call the police to the scene to validate insurance and take a report if any accident or break-in occurs. At the scene of any accident, I will obtain all information from other parties involved, including names, addresses and witnesses, and I will not accept blame or direct fault or accept any type of settlement or offer without the written consent of the Company.  
  • I may not smoke or allow pets in the Rented Equipment. If the Company finds any evidence of smoking, vaping, or pets in or on the Rented Equipment, the Company may assess an additional but not limited to, minimum cleaning fee of $500. 
  • I am not allowed to cook anything inside of the vehicle or tent.  If the Company finds any evidence of this, the Company may assess an additional but not limited to, minimum cleaning fee of $500.
  • I am allowed to fillet, store, and cook fish fillets on the rented equipment.  However, I must ensure that all scales and scents are vigorously cleaned off of the rented equipment.  I will NOT make any fish soup or any other dish that may leave behind odour on the rented equipment, otherwise I will be liable for a cleaning fee of $40/hr.
  • I am responsible for observing vehicle fluids, including fuel, coolant, oil, brake and transmission fluids. I am responsible for monitoring vehicle warning lights, temperature gages, and dash alarms. I will immediately report any issue to the Company and will not use the vehicle when fluids are low or it is otherwise reasonable to expect that continued use of the vehicle will cause damage. 
  • I am responsible for ensuring that all loads are property and safely secured using the supplied roof racks and straps.
  • I am responsible for verifying all overhead clearances. 
  • I acknowledge that one spare tire may be provided with the vehicle.
  • I will be responsible for any and all towing, storage, repair and any other costs incurred by the Company if a breakdown results from improper operation or use of the Rented Equipment, including without limitation, accidents, operating the vehicle without proper fluids, driving on unauthorized roads or terrain, driving in a hazardous or illegal manner, improper use of clutch, or using the Rented Equipment in a manner that otherwise violates the terms of this Agreement. 
INSURANCE AND INDEMNITY
  • I accept the Insurance terms and conditions as presented in this agreement.
  • I am responsible for the cost of replacing windows or locks if the Rented Equipment is broken into. I understand that my personal effects are not covered by the Company or comprehensive insurance. 
  • I agree to indemnify, defend, reimburse and hold harmless (in other words, I agree to pay for…) the Company, its owners, officers, representatives, and anyone else acting on its behalf (collectively, the “Company Parties”), for, from and against any and all claims, demands, penalties, fines, liabilities, obligations, losses, settlements, damages, costs and expenses resulting from or arising in connection with the Rented Equipment, including without limitation, the selection, rental, delivery, possession, use, operation, maintenance, repair and return of the Rented Equipment, or as a result of the use, maintenance, repair, replacement, operation or condition of the Rented Equipment, or as the result of any act or omission by me or any other individual in My Party, or arising in connection with any breach of this Agreement. 
CONTRACTUAL NATURE, RELEASE AND WAIVER
  • On behalf of myself and My Party, I agree that the terms and conditions of this Agreement. 
  • In consideration of the rental of the Rented Equipment by the Company to me, I hereby agree to release and discharge the Company and the Company Parties, on behalf of myself and My Party, and our respective parents, heirs, assigns, personal representative and estate as follows:

Inherent Risks. I acknowledge that I AM ULTIMATELY RESPONSIBLE for my own safety during my participation in renting and using the Rented Equipment. I also understand and acknowledge that if I fail to drive safely (including keeping left, going extremely slow around corners, not exceeding 80km/hr at any time, etc.) my risk of injury or of not surviving an accident or incident while renting and using the Rented Equipment in increased. 

The inherent risks associated with the Rented Equipment include, but are not limited to: failure and breakage of the Rented Equipment, which may lead to accidents, property damage, personal injury or death.  I may encounter TERRIBLE DRIVERS, INTOXICATED DRIVERS, POOR ROAD CONDITIONS, bumps, ditches, rocks, culverts, barriers, bridges and fences. I also acknowledge the risk of using the Rented Equipment ON gREAT BARRIER ISLAND, IN THAT MANY AREAS ARE AT RISK OF, BUT NOT LIMITED TO, FLOODS, SLIPS, HIGH WINDS, LOW VISIBILITY, HEAVY RAIN, TSUNAMI AND EARTHQUAKE ACTIVITY, AND STRANDING DUE TO WEATHER CONDITIONS.

I also acknowledge that I may face risks associated with latent or apparent defects or conditions in the Rented Equipment, which I have inspected and find to be satisfactory and suitable for the purpose that I rented the equipment for. It is possible that I can be seriously injured.

The Company is simply a rental COMAPNY and is not and cannot be REQUIRED to respond in the event of an emergency.  THE COMPANY WILL DO ITS BEST TO ASSIST IN ANY WAY THAT IT CAN, BUT SHOULD NOT BE RELIED UPON.  I acknowledge that I may be left alone, unsupervised and/or out of contact with the Company during the period of my use of the Rented Equipment. I acknowledge that, in the remote locations in which I might use the Rented Equipment, I may experience extreme environmental and/or weather conditions. Exposure to the natural elements can be uncomfortable and/or harmful and I am aware that this exposure could cause sunburn, dehydration, heat exhaustion, heat stroke, heat cramps or fatigue, frostbite, etc., some or all of which may diminish my or the other participants ability to react or respond.  the terrain in which I might use the Rented Equipment can be difficult and in the event of an accident, rescue and medical treatment may be significantly delayed or unavailable. I acknowledge the potential lack of immediate or nearby medical treatment or other services. I acknowledge that I AM ULTIMATELY RESPONSIBLE for my own safety during my use or rental of the Rented Equipment. 

Express Assumption of Risk As lawful consideration for being allowed to rent the Rented Equipment, I expressly agree and promise to accept and assume all the risks. My/our use of the Rented Equipment is purely voluntary, and I/we elect to participate in spite of the risks. I/we expressly agree and acknowledge that the terms and conditions of this Agreement are contractual in nature and that I/we are signing it of our own free will. 

DEFINITIONS

As used in this Agreement, the following terms have the following meanings: 

“Rented Equipment” means, collectively, the vehicle and camping or other related equipment that I have rented from the Company as identified on my rental reservation receipt.  In some instances the term “vehicle” is used to specify the specific part of the Rented Equipment

“You”, “I” and “Renter” means the individual signing this Agreement. 

“Company” means Stay High Island Camping Co., a limited liability company. 

“My Party” means me, any authorized drivers, and any and all other persons who are using, accessing or occupying the Rented Equipment, including any friends, guests and invitees, at any time.  Any covenant applicable to me shall also be applicable to anyone in My Party even if not specifically stated in this Agreement.
